I've been off multiple times for multiple surgeries over my 19 years and have never lost any vacation or personal time.

One year I missed over 30 days for FMLA and lost half of my Vac time. Best thing would be to check with Labor.

Under fmla the law says you can't be penalized in anyway for being on it.Seemslike that would be illegal

If I were you I would consult your contract book.......what's that? You don't have a contract book? I guess it's only been 10 months, we can't expect the union to get that out to us so soon. Maybe they're waiting until the EOS is settled? Maybe they're still recovering from the Vegas vacation, er, I mean "convention", or maybe, just maybe, they could give 2 fucks about the rank and files needs. Have a nice day!
And by the way, be prepared to not get dick on the EOS, and when you don't get said dick, be prepared to hear, "you approved the contract"

Under fmla the law says you can't be penalized in anyway for being on it.Seemslike that would be illegal FMLA laws state that the company (any company) can force you to use any and all vacation/personal time if you have any when you use FMLA. The law also states that when on FMLA and not using vacation/personal time that those hours NOT worked can go against any future accrued vacation/personal time as well as seniority/retirement hours needed. You must work 1250 hours to be eligible for FMLA each year. In other words, yes, they must allow you 12 weeks off for FMLA but they are not required to let that time off count towards any future benefits, they are however mandated to keep your health insurance going.

Yep pretty much what I was told.
