Heard there where nails out in the parking lot, and voith was out there cleaning them up. Heard nails were from the transfers.

Anyone have any insight as to why teamsters is striking in front of our plant? stopped and talked to one of the teamsters today,they said voith refused to recognize the teamsters even though nlrb already ruled in favor of the teamsters.

Read something across TV early this morning that Voith was firing employees without representation as well. Hope they're not referring to the UAW as the without representation.

Voith sucks!! Just my opinion. Yes and No. Some of their employees are really nice people and some are as worthless, well as our IUAW and UAW leadership. They are hired to keep things clean, just like our leadership was elected to keep things..... well....never mind. Enjoy walking on the urine stained floors and no toilet paper.

Voight has fired workers and replaced them with scabs. Even though the NLRB has ruled against Voight on several occasions, they (Voight) will not recognize the Teamsters as the official bargaining agent for the workers!

The workers that are on strike are not the ones in cleanup,they are the ones who drive the cars to load on trailers and rail cars.I am pretty sure the railroad refused to do a rail switch this morning because they are union and would not cross the picket line.

On December 21, 2012, Administrative Law Judge Bruce D. Rosenstein of the National Labor Relations Board issued a Decision & Order against Voith Industrial Services, Inc. (a Ford Motor Co. contractor), the United Auto Workers (Detroit, MI), and United Auto Workers Local Union No. 862 (Louisville, KY). Judge Rosenstein found that Voith, UAW, and UAW Local Union No. 862 had engaged in a number of unfair labor practices at Ford’s Louisville Assembly Plant including the denial of workers’ rights under the National Labor Relations Act.
The violations stem from an unlawful scheme to displace and discriminate against workers employed at the facility, as well as unlawfully recognize the UAW as the collective bargaining representatives of jobs historically maintained by members of Teamsters Local Union No. 89 (Louisville, KY) since the early 1950’s.
In February, Voith was awarded a contract from Ford to receive the new Ford Escapes flowing from the facility and stage them for transportation to dealerships across the nation. Voith and the UAW (collectively) conspired to terminate the employment rights of approximately 166 individuals already employed in the receiving operation at the facility. The intent of the actions taken by the UAW, Local 862, and Voith was to disgracefully strip the fair wages and benefits paid to any employees holding those jobs.
A formal Complaint was issued by the NLRB against Voith, UAW, and UAW Local No. 862 on June, 19 2012, seeking back-pay and restoration of employment for any affected employees unlawfully displaced. The Complaint was defended by Attorneys Gary Marsack (Milwaukee, WI) and Stephen Richey (Cincinnati, OH) on behalf of Voith and Michelle Henry & Irwin Cutler (Louisville, Kentucky) on behalf of the UAW and UAW Local Union No. 862. After a lengthy hearing, Judge Rosenstein issued a 34 page Decision in favor of Teamsters Local 89 and its members.
The remedy contained in the Decision includes a full back pay and benefits award for every unlawfully displaced worker likely amounting to several million dollars. As well, Judge Rosenstein ordered all Local Union No. 89 members be immediately returned to their previous positions and issued a Cease and Desist Order against any ongoing unlawful activities of Voith, UAW, and UAW Local Union No.862.
“Judge Rosenstein’s Decision is a victory for the hard working members of Local 89 employed at Ford’s Louisville Assembly Plant”, said Local 89 President Fred Zuckerman. “Unions should be working to protect wages and benefits of hard working Americans, not conspiring to undermine them.”

Voith was found to have: *Violated Section 8(a)(1) of the National Labor Relations Act by informing applicants they would be required to be a member of the UAW and refrain from engaging in protected union activity under Section 7 of the Act. Judge Rosenstein also ruled Voith’s action in denying Teamsters Local 89 access to its employees while granting access to the UAW was in further violation of the NLRA.
* Violated the act in Section 8(a)(1) and (2) by allowing the the UAW to meet with its employees on work time to urge employees to sign “check-off” authorizations. The contractor further violated the law in giving recognition to the UAW despite it not representing “an uncoerced majority of the unit”.
*Executed a plan to hire 84 employees with the intention of discriminating against members of Teamsters Local 89 who were former members of Auto Handling Inc. because they were exercising their right to engage in concerted activities. Judge Rosenstein also found this was also with the intention of avoiding “an obligation to recognize and bargain with the Teamsters.”
*As a successor employer, Voith had and obligation to bargain with Teamsters Local 89 as the employees’ representative. Having refused to do so, the company violated Section 8(a)(1).
The UAW and UAW Local 862 was found to have:
*Engaged in unfair labor practices in receiving assistance and support from Voith in its meetings with employees to urge employees to sign membership cards and check-off authorizations.
*Illegally obtained recognition while not representing an “uncoerced majority” of employees. Coerced employees to sign membership cards and check-off authorizations.
The remedy handed down by Judge Rosenstein includes in relevant part:
* immediate restoration of employment to the 166 Teamster members who lost their jobs as a result of Voith’s unfair labor practices.
*employees will be repaid for any loss of earnings due to discrimination against them. payment of delinquent employee benefit fund contributions.
*Orders for Voith to bargain with Teamsters Local 89 and rescinded the unilateral wage and benefits reductions. all current employees hired by Voith will be compensated for the lost wages resulting from Voith’s unilateral decision to reduce wages and benefits.
*A Voith official will be required to read aloud the notice of violation to employees

The article above explains why the Teamsters went on strike, after 2 years of fighting, strike was the only alternative since Voith would not leave or follow the law. Maybe you UAW members should consider what all Bob King and Steve Stone did and didn't do. They are gone, but the mess they have left behind isn't. They should have stood with Teamsters not against them. I would be asking UAW now, why we didn't walk with Teamsters, because they would and have walked with UAW in the past. Plus A new Ford contract coming up, do we not want all the help we can get and get rid of this stupid two tier etc. Surely if a little over 100 Teamsters stuck together we a much larger body of people can (UAW) can. Their are more articles on channel 11 WHAS and channel 41 WDRB about this Teamsters, UAW, Ford, Voith fight. Just a few things to ponder.......

I happen to be one of the Teamsters that was put out of a job by Voith/FoMoCo/UAW. I have been a Teamster for nearly 20 years and I have never been more proud of my TEAMSTER LAP family and Local 89. We put up an awesome, long fight and came out victorious. We managed to scare Voith and the scabs they brought with them away. I know for a fact (& their is much proof in the court proceedings) the UAW colluded with FoMoCo/Voith to do away with myself/coworkers and our union representation. It was dirty and underhanded and I have never in my life witnessed one union stab another in the back as the UAW did. I feel sorry for any good union man or woman that has to be represented by that local and Todd Dunn. What a disgrace. I know some good UAW workers on the lines at both plants and I know they were and are on our side. I, also, can not understand how your membership even allowed the two tier system to even become to fruition. Again, another disgrace that was probably encouraged by your crappy leadership. I say vote them out and get a strong union back together that you can be proud of! Better yet, come to the Teamster side! LOL

most local 862 members didn't even know what was going on . our local never said anything about this mess to us because as the court said, they were in on the whole deal to get rid of local 89. in all my 32 years as a uaw member i have never seen anything even close as to what our local 862 tried to pull off. it took the brothers and sisters at BLET 78 and SMART TD 376 working with local 89 to bring this mess to a victory for the teamsters . i wounder how many millions our iuaw spent on court cost to defend themselfs in this lawsuit that they lost. Teamsters local 89 , i can't speak for any other uaw member but please accept my apology for the wrong doing of our union and for our local and iuaw not standing up for the rights of the voith teamsters workers.

Thank you proudtobeateamster. You should be proud.... And dozerman I am sure Teamsters would accept your apology, because they know it is UAW leadership not the members, that didn't do their job. But a new year and a new contract is coming up, we need to be union strong and demand from our leaders to keep us informed and work together for us a better future instead of corporate prospering,politicians prospering, and our UAW leaders not doing the job we put them in there to do. That is, work for us and guide us to stay strong as a brotherhood plus stay strong with outside unions like Teamsters. But most importantly demand a equal pay for all UAW brothers and sisters, not a two tier. Together we STAND, divided we FALL........ dozerman one more thing, it wasn't voith workers that were screwed, it was the 166 Teamsters that had those jobs and were never called back after retooling at FORD LAP. Ford and UAW allowed Voith to take the contract and they used people through Aero - tech temporary services to do a job that Teamsters are considered professionals at. But that's all water under the bridge Teamsters are back !!!!!!!! Lets mend relationships because we may need their support next year. Or as proudtobeateamster put it, maybe we should join them if our leadership doesn't straighten up and do their job for US !!!!!!!!!!!!!!!!!!!! Union strong !!!!!!!!!!!!!!! The only way !!!!!!!!!

Hey folks. I'm also one of Teamsters with 2 decades+ of experience loading the new units on railcars that was replaced by unskilled labor by Voith in 2012 to save a few bucks. Voith only hired about a dozen of us (of the original 161), by accident in my opinion, and I was one of them. We fought a long tough fight but we have won it!! Now that that SOB Steve Stone and some of his clan are out of the picture, I urge the UAW rank and file to STAND UP AND TAKE YOUR LOCAL BACK!! I have personally over the years stood on dealership lots handing out handbills in support of UAW, in crappy weather for your cause. We (Teamsters) and the UAW Local 862 always worked together in the past and I hope to see that again soon!! Be sure you listen to the OLDER guys on who really has your back when you vote. They are the ones who have had to fight at one time or another to secure a fair days work for a fair days pay. We all have to stick together to make it all happen and I can assure you the Teamsters have your back too!!!!!!!
