Things you should know
LOCAL CONTRACT: The local contract addresses issues within a specific locality.
Issues such as breaks, processes on the floor, plant services, basic day to day
work routines, etc.
NATIONAL CONTRACT: The national contract addresses the bigger issues such as;
Wages and bonuses
Product distribution among plants
Benefits, etc.
WEINGARTEN RIGHTS: Employees have a right to have a union representative present
during an investigation interview. This view is supported by the 1975 U.S.
Supreme Court decision, NLRB v. Weingarten, which rules that an employee may be
represented by the union at an investigation interview with his/her employer
when the employee reasonably believes that the interview may lead to
disciplinary action. If the employer denies the request for union
representation, and continues to ask questions, it commits an unfair labor
practice and the employee has the right to refuse to answer and the employer
cannot discipline the employee for the refusal.
MEDICAL PLACEMENT – (Per Local Agreement page 3) The Company will place
medically restricted personnel in accordance with the terms of the Collective
Bargaining Agreement and Letters of Understanding. An employee will not be
placed on “No Work Available” until this process has been exhausted except
in cases where there is a change in physical status or by mutual agreement. The
Medical Placement procedure can be found in this agreement by referencing
“Medical Restriction Placement Committee” in the Local Letters of
Understanding (page 92)
FIVE (5) DAY NOTICES -- Article VIII, Section 4 of the Master Agreement
describes the reasons for which seniority shall be broken. Subsection (4)
addresses Failure to Report and prescribes the form of the five-day notice that
the Company must send to an employee's last known address according to
The Company's records. Therefore, you should keep the Company record of your
address up to date at all times. Failure to do so may result in loss of
seniority and termination of employment. All notices are sent according to the
Company records; therefore, if the notice is not claimed by the addressee, it is
not considered to meet the test of “impossibility” to respond to the notice.
*Should you receive a five (5) day notice, it is YOUR responsibility to
communicate with the Company within five working days after the notice is sent
(excluding Regular Days Off and Holidays). This responsibility is excused only
by proof that you were unable to respond.
EARLY BREAK PERIOD - In an effort to improve morale in the workplace the Company
agrees to the following practices concerning break periods. Regularly scheduled
break period can only be changed once per Crew/Shift. The Company and the Union
will investigate issue caused by early break and look for alternatives to pilot
in an attempt to lessen the impact. (i.e. for personal relief needs between
break and lunch) Emergencies are break downs in excess of 18 minutes. The
parties agree that as a normal practice stock shortages are not considered as a
reason to go to early break. In the event early break is required, the company
will attempt to delay the start of relief until operations are able to resume
upon return. The Union will be notified by Labor Relations prior to such a
change and all employees will be given a 12 minute notice before making such a
change.
LUNCH SCHEDULING: (Article X Section 6B page 134 Master Agreement)Except in
emergencies, an employee’s regular lunch period shall not be advanced or
delayed by more than one hour unless the employee agrees to such change. The
company has the right to change your lunch within one (1) hour of your regular
scheduled lunch period.
-Break and lunch are two separate events; therefore the company can schedule one
(1) early break and early lunch in the same day.
