Like many others from LAP, I would like to know if there is a book or printout of the MOA. I have heard many rumors about what the original said, but would like to read for myself. It is hard to be definitive about any answer about the contract without knowing if it is printed material or not.
Maybe Kessinger can answer this question. Thanks in advance.

The only thing you need to know is on page 82 where it reads 'The company can do whatever the company wants to do'.

I believe the MOA agreement states it is a living document therefore all literature is a grey area period.

It is a very short document! Page one says "They can do that!". Page two says "When in doubt see page 1!" I hope this info helps!

It has been my experience that when a membership reads and understands their rights - they stand together.
Information, contractual or otherwise, is the key to unification of the floor. The floor, for lack of better terms, IS the union. The members in the office are the elected officials that REPRESENT the UNION of people that work on the floor.
That is my personal problem with the LAP/KTP whipsawing. It is the only way they can combat the real union. Which is, make them self destruct from within.
It may have worked in the beginning of 2009. I personally feel every one involved at KTP now understands the bigger picture. It is time to stand together as one.
Only then can the elected officials be effective in their endeavors. And that is when they hear only one voice.............

Wouldn't the newer COA trump the older MOA ? Or are the two totally different contracts?

Ok, class of 95 is somewhat right. But neither the COA nor the MOA exists anymore.
Both of these agreements were done outside of the normal contract times. The agreements they produced were either folded into the contract at the next negoiations or they disappeared. So there is no guiding document other than the local or nat. contracts
So there is no MOA or COA anymore.
Now we do still have contractual language that has continued on since both agreements, most have changed quite a bit since the originals, and they are:
1.Team Work agreement pg.26 (What the MOA realy was) 2.Equalization of overtime pg.34 (MOA) 3.ARPS pg 42.
There are two later letters about launching MOA in material handling. They just basicly state that MH will also be under the MOA.
And thats it. Anyone telling you that the company doesn't have to follow procedures concerning job standards, OIS, JSA, or whatever other program because we are MOA is telling you wrong. The only thing the MOA changed was it created teams/teamleaders and left job rotations and placements to the team.
So if you feel something isn't being done properly, and your committeperson hasn't helped fix it. Then contact one of the BC, don't just write it off as "ah, it's that damned MOA"

Thank you kindly, Mr. Kessinger. It is always great to have a bargainer to answer questions. I want to thank you for taking your personal time to do this for the ones that frequent this board. I hope everyone realizes how much of your personal time you donate to the membership on a regular basis.
